The plot thickenened Tuesday in the fight over the estate of fallen Wharton firefighter Thomas Araguz.Carolyn Bosma came forward on behalf of the firefighter's widow, Nikki Araguz, Tuesday. Bosma said she she will testify that Thomas Araguz knew his wife was a man by birth.
Bosma, who works at a transgender clinic, said Nikki and Thomas visited the clinic together in 2007.
Representatives with the Transgender Foundation of America said Bosma's testimony is further proof of the validity of the Araguz marriage.
Thomas Araguz died in a fire earlier this year. Several hundred thousand dollars in his estate could be on the line. Both Nikki and Araguz's ex-wife, Heather Delgado, said they want the money for Delgado and Araguz's children.
Both sides point to the law to justify the validity of Nikki and Thomas's marriage. Nikki's representation points to a part of the Texas Family Code that references sex changes. Delgado's attorneys say the overriding issue is that same-sex marriage is illegal in Texas.
The final decision is in the hands of the court.
