LUDACRIS TICKET SWEEPSTAKES
OFFICIAL RULES

KIAH-TV and KPTY 93.3 present the “Ludacris Ticket Sweepstakes” (the “Sweepstakes”).  
No purchase necessary to enter or claim a prize. Void where prohibited and outside the Houston Designated Market Area.  

1. HOW TO ENTER: 
Sweepstakes runs from Monday, November 17, 2008 at 6 pm (CT) through Thursday, November 20, 2008 at 11:59 pm (CT) (the “Sweepstakes Period”). Sponsor’s clock will be the official timepiece of the Sweepstakes. During each night’s airing of Family Guy (Monday-Thursday at 6:00 pm and 11 pm) during the Sweepstakes Period, a keyword will be displayed on screen and viewers must text 39239 with the correct keyword contained in the body of the text message.  All entries must be received by 11:59 pm (CT) on the day that episode airs (i.e., November 17, November 18, November 19, and November 20.)  All entrants must have a text messaging two-way capable handset and digital service in order to enter the Sweepstakes using the text messaging method.  Entrants will be sent a text message to confirm entry into the Sweepstakes.  By participating via text, entrants will be charged standard rates for text messages sent and received from their handset according to the terms and conditions in their wireless calling plans.  Text messaging and wireless service are not available in all areas.  

2. ALTERNATE METHOD OF ENTRY: 
In an alternative to text messaging, you can also enter online by going to 39online.com, clicking on the Contests tab, clicking on the Party 93.3 Ludacris Ticket Sweepstakes button and submitting your name, age, address, telephone number, cell phone number, email address, and providing the correct keyword for that day.  Sponsor is not responsible for faulty Internet connections, unavailability of servers or any other technical malfunctions.  
Only one entry per person per day will be allowed.  You cannot enter both online and by text messaging on the same day.  Any attempt by any entrant to obtain more than the stated number of entries using multiple/different identities or registrations will void such entries and that entrant may be disqualified. No electronic or mechanically reproduced entries, and the use of automated or third-party software of website to enter is prohibited. Entries that do not include the correct keyword, or any other required information that is required will be disqualified.  Entries will be accepted starting at 6:00 pm up till 11:59 pm each day during the Sweepstakes Period. Only entries complying with the entry rules shall be counted in the Sweepstakes.  Sponsor is not responsible for inability to complete call within specified time whether due to busy lines, disconnections, telephone malfunctions or other circumstances.  Sponsor not responsible for entries that are lost, late, misdirected, or illegible. Entries become the property of KIAH and will not be returned.  Odds of winning prize each day depend on the number of eligible entries received for that day’s drawing.   
All text message entrants and on-line entrants will receive a bounce-back message with a Channel 39 promotional message.

3. WINNER SELECTION AND NOTIFICATION: 
A total of eight (8) winners will be selected.  Two winners will be selected immediately at the end of each Sweepstakes date in a random drawing from among all eligible entries received that day. Entries do not carry over from one day to the next.  Sponsor will attempt to contact potential winners the day after the day for which they were chosen, example: Sponsor will attempt to contact Monday, November 17, 2008 winner by telephone on Tuesday, November 18, 2008. Winners must acknowledge notification within forty-eight (48) hours of the first phone call by calling (713) 435-2891.  Sponsor will be the sole and final judge of eligibility, winner verification and all other matters connected with the Sweepstakes.  Winners must meet and agree to all eligibility requirements, terms and conditions mentioned in Official Rules.  Winners will be awarded prizes upon verification of eligibility requirements.  If a winner cannot be contacted or reached within forty-eight (48) hours of the first notification attempt, declines the prize, or is deemed ineligible to participate, then he/she will be disqualified and Sponsor may choose an alternate winner from among the remaining eligible entries for that day.  

4. PRIZES:
Prize: Each one of eight winners will receive four (4) tickets to the Friday, November 21, 2008 Ludacris Concert at Hush Night Club.  All tickets for the concert are complimentary, but are available only on a limited basis. Approximate retail value (“ARV”) of prize is estimated at $8.00 per ticket.  ARV of each prize: $32.00. Total ARV of all prizes: $256.00. No cash redemption or prize substitution allowed by winner.  Winners my claim their prize prior to the concert at the KIAH Studio located at 7700 Westpark Dr. Houston, Texas 77063 between the hours of 8:30 am and 5:30 pm (CST) Monday through Friday. (Excluding all major Holidays)  Prize is non-transferable and has no cash equivalent. Sponsor reserves the right to substitute a prize of equal or greater value if the prize is unavailable and/or undeliverable for any reason in the sole and complete discretion of Sponsor.  Winners are responsible for all taxes on prizes. One prize per person or family. All properly claimed prizes will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.  

5. ELIGIBILITY RESTRICTIONS:
a. The Sweepstakes is open only to legal citizens of the United States who are legal residents of Houston, Designated Market Area (DMA) according to the Nielsen Company and who are 18 years of age or older as of Sunday, November 16, 2008 and who possess a valid I.D.  
b. Employees (and their immediate family or household members) of Channel 39 ("Sponsor") and KPTY 93.3 and their respective subsidiaries, sponsors, affiliates, parent companies, assignees, agencies, advertisers, franchisees, are not eligible to win.  
c. Any member of a household that has been awarded a prize in any other contest by Channel 39 in the past 30 days is ineligible.

6. CONDITIONS OF ENTRY:
a. Execution of Affidavit and Release:  The prizewinners are required to sign and submit a release and waiver of liability.  To claim the prize, the prizewinner will be required to provide picture proof of identification, which may include a driver’s license, passport, voting card or similar government issued identification.  
b. Use of winner's name:  By entering, each entrant grants permission, without further compensation, to Sponsors and their agents and licensees, to use the entrant's name, voice, photograph, likeness and biographical material for broadcast and promotional purposes in connection with the Sweepstakes in the event entrant is a winner.
c. Release Sponsor of Liability:  By entering, entrants agree to release Sponsor and its parent companies, affiliates, officers, directors, employees, licensees, representatives & agents from any claim, loss, liability, damage or injury of any kind arising from the entrants’ participation in this Sweepstakes.
d. No Warranties:  By entering, each entrant agrees and acknowledges that Sponsors have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relating to the prize, including but not limited to, the quality, merchantability, habitability, mechanical condition, or fitness of the prize.

7. OTHER CONDITIONS / FORCE MAJEURE:
If for any reason, this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, interruption in wireless calling devices or wireless service, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Sweepstakes, Sponsor reserves the right, in their sole discretion, to terminate or suspend the Sweepstakes or any portion of the Sweepstakes. In the event Sponsor terminates the Sweepstakes, Sponsor shall post notice of its action at the Sweepstakes website and shall award remaining prizes in a random drawing from among all eligible entries received as of the time the Sweepstakes is terminated. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES.  
Information submitted in text messaging and Internet entries, including entrant's name, address, e-mail address, etc, shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with the KIAH-TV online privacy policy, which can be found at 39online.com.  Sweepstakes shall be governed and enforced pursuant to Texas law, excluding choice of law provisions.
In the event of a dispute as to who submitted an entry, it will be deemed submitted by the “Authorized Account Holder” at the time of registration.  The "Authorized Account Holder" is the person assigned by a wireless calling/text message carrier service, an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning accounts and email addresses.  Potential winners may be required to show proof of being the authorized account holder.
